Ohio statute governs the termination of a marriage through a legal separation. A legal separation leaves the marriage intact, but allows the parties to divide assets and debts – and address their continued relationship with their children, through the legal separation proceedings. And, importantly, permits that any property acquired after legal separation to be the separate property of the receiving spouse.
Legal separations are not common in Ohio, simply because most spouses seeking termination of their marriage want that — a termination of the marriage. That being said, a legal separation can be an effective tool for spouses looking to accomplish very specific goals for themselves.
We encourage you to seek competent counsel if you are considering a legal separation so that you can provide your facts to a lawyer and receive an honest assessment on whether a legal separation can meet your goals.
